There the\nconcept of the patrimony takes the shape of a universality\,\ncompos ed of items of property as well as of obligations\, and is\ngenerally tied to a person.  This idea is also embodied\nthrough collective patrimonies -already know to the Romans under\nthe metaphorical expression patrimonium populi\, which\nmeant public treasure- composed of property\, of informat ion\, of\nfeatures that are judged essential for society\, the human race or\nits environment.\n\nWhether the patrimony is personal or collective\, it also conveys a\nsense of transmission. Among other things\, it brings t o mind the\npatrimony of the deceased and his succession\, the circulation in\nthe market of rights we dub 'patrimonial' or\, just as well\, the\nin heritance constituted by cultural\, genetic\, and biological\npatrimonies. \n\nIf the patrimony is\, on balance\, an assemblage of transmissible\nthi ngs\, its content nevertheless remains unclear and the categories\nwhich a rise from it remain porous.\n\nFor example\, what are we to make of the ec onomic facets of\nextrapatrimonial rights? What are the rights in one's im age\, if not\na monopoly similar to intellectual assets? Thus\, what could they be\nif not 'intellectual property'? Moreover\, shouldn't we see all \nprivileges which bear an economic cast as patrimonial rights?\nAnd what of intellectual property rights with respect to\ntraditional know-how? Are marketing and development appropriate\nlegal mechanisms to address the su bject-matter of the patrimony\nconstituted by cultural heritage or\, more generally\, to address the\nfield of creation?\n\nFrom private law to inte llectual property law\, the concept of the\npatrimony leads to the use of legal categories whose bright-lines\nseem ever more clouded and grey\, if not to say ever more mythical.\nBesides\, will metaphors serve as pedagogi cal devices\, thereby\nallowing us to better grasp the nature of these pat rimonial\nfissures?\nThose interested in attending this second seminar wil l be able\nafter November 5th\, to consult the texts and images prepared b y our\npanellists and\, if they wish\, publish their own comments (with th e\nimages of their choice) on the M&M website.\nPanellists:\nLionel Smith\ , France Allard and Valérie Laure Benabou\nPublish your comments!\nFor thi s third seminar\, we offer interested persons the\npossibility of publishi ng a comment on our website as to the text\nof one of our panellists.\nEac h comment must include a text with a maximum length of 600\nwords and\, if possible\, one or a few images meant to illustrate the\nprincipal ideas o f the text.\nThese comments can be transmitted to us\, before or after the \nseminar\, by eric.labbe [at] mcgill.ca (email).\n DTSTART:20091119T173000Z DTEND:20091119T190000Z LOCATION:Chancellor Day Hall\, CA\, QC\, Montreal\, H3A 1W9\, 3644 rue Peel SUMMARY:'Patrimoine / Patrimony' - a Myths and Metaphors Seminar on IP and Private Law URL:/channels/event/patrimoine-patrimony-myths-and-met aphors-seminar-ip-and-private-law-111368 END:VEVENT END:VCALENDAR
